THESE TERMS AND CONDITIONS constitute a binding agreement on the provision and security of valuable information ("Agreement") between the end user, brands (hereinafter collectively referred to as "Customer") and Flamingo Digital Joint Stock Company (hereinafter referred to as "Flamingo" or "we"). Customers are kindly requested to read the content of the Agreement carefully. By clicking on the "Agree" button, you confirm that you have understood and accepted the terms and conditions of the agreement.

Introduction to Flamingo

Privacy Policy
2.1 By providing information to us, Customers confirm and agree that they understand, allow, and accept the way FLAMINGO collects, compiles, uses, provides, stores, and/or processes Personal Data (as defined in Section 3.1 below) received during the provision of Services to the Customer.
IF YOU DO NOT AGREE TO ALLOW THE PROCESSING OF YOUR PERSONAL DATA AS DESCRIBED IN THIS AGREEMENT, PLEASE DO NOT USE OUR SERVICES.
2.2 FLAMINGO commits to seriously implement its responsibilities related to information security according to the regulations on network information security and personal information of Vietnamese law (collectively referred to as "Privacy Law"). We recognize the importance of the Personal Data that Customers have entrusted to us and believe that it is our responsibility to manage, protect, and process the Personal Data of Customers appropriately.

Collection of Personal Data
3.1 "Personal Data" means data, whether true or not, about (i) product information, services, promotional programs, commercial promotions, survey content, reviews, and other information about product business, services in the market; and (ii) personal information, images that can identify the individual's identity.
3.2 We will/may collect Personal Data of Customers:
(a) When Customers register and/or use Our Services or Platform, or open an account with us;
(b) When Customers submit any form, including registration forms or other forms relating to any of our products and services, in an online form or other forms;
(c) When Customers enter into any agreement or provide other documentation or information in relation to interactions with us, or when using our products and services;
(d) When Customers interact with us, such as via telephone calls (which may be recorded), letters, face-to-face meetings, social media platforms, and emails;
(e) When Customers use our electronic services, or interact with us via our platform or Services. This includes, but is not limited to, through cookies that we may deploy when Customers interact with our Platform;
(f) When Customers carry out transactions through Our Services;
(g) When Customers provide feedback or submit complaints to us;
(h) When Customers register for a contest or subscribe to a program on the Platform;
(i) When Customers submit their Personal Data to us for any reason.
The above is not an exhaustive list of instances when we collect Personal Data from Customers, not reflecting all circumstances where we will collect Personal Data from Customers.
3.3 We want Customers to understand the types of information we collect when you use our services. Personal Data that FLAMINGO may collect includes, but is not limited to:
(a) Customer's promotional program, product, and service information.
(b) Information on reach, views, interactions (likes, shares, comments, or feedback) on Customer's posts.
(c) Information on the usage frequency, interaction frequency of Customers with Video template samples in the Video template library.
(d) Information on reach, views, number of people registering for a program or advertising campaign gamification of the Customer.
(e) General information about the age, gender, geographical area of the viewers interacting with Customer's content.
(f) Information from survey questions & answers, advertising campaign gamification, which includes but requires the consent of the related participants in the survey such as:
Full name, email, phone number of the questioner and/or respondent.
Full name, email, phone number of the person registering to participate in gamification.
3.4 Customers agree not to provide us with any information that:
(a) Is not complete, inaccurate, misleading, or could cause misunderstanding;
(b) Violates the intellectual property rights of any third party;
(c) Violates any provisions of the Privacy Law for any third party
(d) Is not allowed to be disclosed as per the regulations of government agencies and/or law.
Customers agree to immediately inform us about any non-compliance with the above regulations. In addition, Customers are responsible for informing us about changes to their Personal Data or in case Customers believe that the Personal Data we have is not accurate, incomplete, misleading, or outdated. We reserve the right, at our sole discretion, to process this information appropriately and not bear any responsibility and/or obligations arising from Customer's non-compliance with these regulations, whether unintentional or intentional. For this purpose, we may request Customers to provide other necessary documents to verify the information Customers provide.
3.5 If Customers do not wish us to collect Personal Data, Customers may opt out by notifying us in writing of the request to delete the Personal Data provided. However, please note that the implementation of this request by Customers may affect the use of Our Services and Platform and/or FLAMINGO will not continue to provide the Services to Customers. FLAMINGO's legal rights and remedies are reserved in that case.

Collection of Other Data
4.1 As with most other websites and Mobile Platforms, the Customer's device sends information that may include data about Customers, which a web server records when Customers use our Platform. This information usually includes but is not limited to the IP address, computer/mobile device operating system, browser type, mobile device type, features of the mobile device, unique device identifier (UDID) or mobile equipment identifier (MEID) of Customers' mobile device, referral website address (if any), pages Customers visited on our website or Mobile Platform, and the time of visit and sometimes "cookies" (which can be disabled using your browser settings to help the website remember your last visit). If Customers log in, this information is linked to their personal account. This information is also included in anonymous statistics to help us understand how visitors use our website.
4.2 Our platform may collect precise information about the location of your mobile device using technologies such as GPS, Wi-Fi, etc. We collect, use, disclose, and/or process this information for one or more purposes including, but not limited to, location-based services that Customers request or transferring content relevant to Customers based on their location or allowing Customers to share their location to other users as part of the services offered by our Mobile Platforms. For most mobile devices, Customers can withdraw permission for us to collect this information based on their location through the device settings. If Customers have questions about how to disable mobile device location services, please contact your mobile service provider or the device manufacturer.

Cookies
5.1 We may use "cookies" or similar features to allow us or third parties to collect or share information that will help us improve our Platform and the services we offer, or help us offer new services and features. "Cookies" are identifiers we send to your computer or mobile device that allows us to recognize your computer or device and tell us how and when Services or Platforms are used or visited, by how many people and to track activity within our Platforms. We may link cookie information to personal data. Cookies also link to information regarding what content you have chosen for shopping pages you have viewed, or games you have played. This information is used to provide content based on your interests and to track the use of the services.
5.2 Customers may refuse the use of cookies by selecting the appropriate settings on their browser. However, please note that if you do this you may not be able to use the full functionality of the Platform or the Services provided.

Use of Personal Data
6.1 We may collect, compile, use, disclose, and/or process Customers' Personal Data for one or more of the following purposes:
(a) To develop better services;
(b) To present the most suitable suggestions to Customers to create content that increases interaction, connects more consumers, and enhances business opportunities;
(c) To conduct market surveys & consumer demand, evaluate consumer satisfaction with Customers' products & services;
(d) To survey preferences, habits, behavior, feedback from consumers regarding brands on social media;
(e) To enforce Our services;
(f) To identify and/or verify;
(g) To maintain and manage any software updates and/or other updates and support that may be required from time to time to ensure Our services run smoothly;
(h) To resolve or facilitate customer service, perform instructions from Customers, resolve or respond to any inquiries sent by (or intended to be sent by) Customers or on behalf of Customers;
(i) To contact Customers or communicate with Customers via phone, text message, and/or fax message, email, and/or mail or otherwise for the purpose of administering and/or managing Customers' relationship with us or Customers' use of Our Services;
(j) To inform Customers when another user has sent Customers a private message or posted a comment about Customers on the Platform;
(k) To conduct research, analysis, and development activities (including, but not limited to, data analysis, surveys, product, and service development and/or profiling), to analyze how Customers use Our Services, to improve Our services or products and/or to enhance the customer experience;
(l) For marketing purposes, in which case, to send Customers through various communication methods, marketing, and promotional information and materials relating to products and/or services (including, but not limited to, products and/or services of third parties which FLAMINGO may collaborate or tie up with) that FLAMINGO may sell, market, or promote, whether such products or services exist now or are created in the future;
(m) To comply with legal procedures or to comply with or as required by any applicable law, and requests from public and governmental authorities;
(n) To compile statistics and research for reporting and/or record-keeping requirements and/or internal;
(o) To conduct due diligence or other screening activities (including, but not limited to, background checks) in accordance with legal or regulatory obligations or our risk management procedures that may be required by law or that may have been put in place by us;
(p) To audit our Services or Platform operations;
(q) To prevent or investigate any fraud, unlawful activity, omission, or misconduct, whether relating to your use of our Services or any other matter arising from your relationship with us, and whether or not there is any suspicion of the aforementioned;
(r) To store, host, back up (whether for disaster recovery or otherwise) of your Personal Data; and
(s) Any other purpose we notify you of at the time of obtaining your consent.
(collectively, "the purposes").
6.2 Because the purposes for which we may/may collect, use, disclose, or process your Personal Data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of that other purpose at the time of obtaining your consent, unless the processing of the data without your consent is permitted by the Privacy Laws.

Protection of Customer's Personal Data
7.1 We implement various security measures to ensure the safety of the Personal Data of Customers on our systems. User's Personal Data is stored behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems. We will maintain Personal Data in accordance with the Privacy Law and/or other applicable laws. That means we will destroy or anonymize your Personal Data when we reasonably consider that:
(i) The purpose for which that Personal Data was collected is no longer being served by the retention of such Personal Data;
(ii) Retention is no longer necessary for any legal or business purposes;
(iii) No other legitimate interests warrant further retention of such Personal Data.
If Customers cease using the Platform and/or Services, or their permission to use the Platform and/or Services is terminated, we may still continue to use, store, and/or disclose Personal Data in accordance with this Agreement and our obligations under the Privacy Law. Depending on the applicable law, we may securely dispose of your Personal Data without prior notice.

Disclosure of Information
8.1 In the course of conducting our business, we will/may need to disclose Customers' Personal Data to third-party service providers, agents, and/or our affiliates or related corporations, and/or other third parties, whether sited in Vietnam or outside of Vietnam, for one or more of the above-stated Purposes.
8.2 For the avoidance of doubt, in the event that Vietnamese law protecting confidentiality of personal information or other applicable laws allow an organization such as us to collect, use, or disclose your Personal Data without your consent, such permission granted by the law will continue to apply.
8.3 Third parties may unlawfully intercept or access Personal Data transmitted to or contained on the site, technologies may malfunction or not work as anticipated, or someone might access, abuse, or misuse information, despite a lack of permission. However, we will deploy reasonable security measures to protect Customers' Personal Data in accordance with the law; nonetheless, absolute security cannot be guaranteed, for instance, when unauthorized disclosure arises from malicious hacking activities or malware content not attributable to us.

Exclusion of Liability for Confidentiality Obligations and Third-Party Sites
WE DO NOT WARRANT THE SECURITY OF ANY PERSONAL DATA AND/OR OTHER INFORMATION THAT YOU PROVIDE ON THIRD-PARTY SITES. We undertake various security measures to maintain the safety of Customers' Personal Data which we hold or control. Customers' Personal Data is stored behind secured networks and is only accessible by a limited number of individuals who have special access rights to such systems, and are required to keep the Personal Data confidential. When placing an order or accessing your Personal Data, we offer the use of a secure server. All Personal Data or sensitive information you supply is encrypted into our databases to be accessed as stated above.

Effectiveness and Changes to the Agreement
11.1 This Agreement becomes effective at the moment Customers click on the "Agree" button. The effectiveness of this Agreement will be maintained until FLAMINGO receives written notice requesting termination and deletion of all Personal Data provided. For the avoidance of doubt, the termination of this Agreement in this case is not retroactive and, accordingly, does not affect the collection, compilation, use, provision, storage, and/or processing of Customers' Personal Data that FLAMINGO has conducted prior.
11.2 Customers agree that FLAMINGO has the right to modify, add to the content of this Agreement at any time. Any changes to this Agreement made by FLAMINGO in the future will be posted on this page, and, where appropriate and/or permitted under applicable law, will be notified to Customers when Customers continue to use the Service. Continuing to use the Services and/or access the Platform will be deemed as Customers' acknowledgment and acceptance of the changes to the Agreement made by FLAMINGO. Please check back frequently to see any updates or changes to this Agreement.
11.3 This version of the Agreement was updated by FLAMINGO on 10/19/2022.

Governing Law
This Agreement is governed and construed in accordance with Vietnamese law.
